Court Won’t Reinstate New York City’s Big-soda Ban
Big Gulps can remain on the menu in New York City. The New York Court of Appeals ruled Thursday not to reinstate the ban on super-sized soft drinks that then-Mayor Michael Bloomberg supported two years ago. In its 20-page ruling, the court said that in adopting the “Sugary Drinks Portion Cap Rule”, which would have capped sugary beverages at 16 ounces, the city Board of Health “exceeded the scope of its regulatory authority.” With the rule, the board went beyond simply making health regulations, but moved into policy-making with the rules that would have effected restaurants, delis, movie theaters, stadiums and street cart vendors.
